Terms of Service

These terms are the agreement between you and FlutterKada, the operator of HeartTap, covering your use of the HeartTap app and this website. By using HeartTap you accept them.

Who can use HeartTap

You must be at least 13 years old, and old enough in your country to agree to these terms on your own. If you are using HeartTap somewhere that sets a higher minimum age for consent to data processing, that higher age applies.

Your account

You are responsible for what happens on your account and for keeping access to it secure. You can start as a guest and add an email address later. If you lose access to a guest account without having linked an email address, we may not be able to recover it, so linking an email is worth doing.

Your content

The photos, videos, drawings and text you share stay yours. You keep all ownership. You grant us only the permission we need to run the service: to store your content, transmit it to the partner you are linked with, and display it in the app and on your widget. We do not sell your content, publish it, or use it to train machine learning models.

You are responsible for having the right to share what you share. Do not upload content you do not have permission to use.

Acceptable use

You agree not to use HeartTap to:

• Harass, threaten, abuse or impersonate anyone.
• Share sexual content involving minors, or any illegal content.
• Share someone else’s private images or information without their consent.
• Break into, overload, scrape or reverse engineer the service.
• Resell or redistribute access to HeartTap.

HeartTap includes tools to block and report. We act on reports, and we may suspend or terminate accounts that break these rules.

Subscriptions and payment

HeartTap is free to download and free to use with daily limits on some actions. A paid subscription lifts those limits and unlocks additional content.

• Subscriptions are billed by Apple or Google through your store account, not by us directly.
• Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends.
• Cancel through your store account. On iPhone: Settings, your name, Subscriptions. On Android: Play Store, profile, Payments and subscriptions. Cancelling stops the next renewal and you keep access until the period you have paid for runs out.
• Refunds are handled by the store that took the payment, under that store’s policy. Email us and we will point you to the right place.
• We may change prices. Any change applies from your next billing period, and we will tell you before it takes effect.

Availability

We work to keep HeartTap running, but we do not guarantee uninterrupted service. Features may change, and we may add, alter or remove them. If we discontinue something significant, we will give reasonable notice where we can.

Ending your use

You can stop using HeartTap at any time and delete your account from inside the app. We may suspend or end an account that breaks these terms or that creates a risk to other users or to the service.

Disclaimers

HeartTap is provided as it is, without warranties of any kind to the extent the law allows. HeartTap is a communication and connection tool. It is not counselling, therapy or professional relationship advice, and the questions and prompts inside it should not be treated as such.

Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential losses, or for loss of data or profits, arising from your use of HeartTap. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited, and if you have consumer rights under the law of your country, these terms do not take them away.

Changes to these terms

If we change these terms we will update the date at the top of this page, and for significant changes we will tell you in the app. Continuing to use HeartTap after a change means you accept the updated terms.

Apple and Google

Apple and Google are not parties to this agreement and are not responsible for HeartTap or for supporting it. Your use of the app is also subject to the rules of the store you downloaded it from.
